We work on the basis of the German Freight Forwarders’ Standard Terms and Conditions (ADSp), in their latest version. Clause 23 of the ADSp limits the legal liability for damage to goods pursuant to Section 431 of the German Commercial Code (HGB) to EUR 5/kg for damage in the custody of the freight forwarder; in the case of multimodal transports including carriage by sea to 2 SDR/kg and, in addition, to EUR 1 million or EUR 2 million or 2 SDR/kg per claim or event, whichever is higher.
